1. Scope & Purpose
This Site Policy governs access to and use of the Talent Eye Training Institute Learning Platform (version 4.5) and any related systems, content, and services. It applies to all users—learners, trainers, assessors, administrators, and guests—whether on campus or remote.
It is aligned with ISO 9001:2015 (Quality Management Systems) and ISO/IEC 27001:2022 (Information Security Management Systems), and guided by TVET Authority (Kenya) standards and guidelines. Alignment means our controls and processes are designed with these frameworks in mind; it is not a certification statement.
2. Definitions
- "Institute" means Talent Eye Training Institute (TETI).
- "Platform" means the Talent Eye Training Institute Learning Platform (v4.5) and integrated services.
- "User" means any person with an account or visitor access.
- "Personal Data" means information that identifies an individual.
- "Assessment" includes assignments, quizzes, practicals, projects, and exams.
- "TVET" refers to Technical and Vocational Education and Training regulatory standards and procedures in Kenya.
3. Acceptance & Consent
By creating an account, logging in, or clicking “I agree” on the Talent Eye Training Institute consent page, you confirm that you have read, understood, and will comply with this Site Policy and any course‑specific rules.
Site administration → Security → Site policies to require acceptance during signup and login.- If you are under the age of majority under applicable law, a parent/guardian must consent where required.
- Where additional consents are required (e.g., media use, special data processing), they will be requested separately in the Platform using custom profile fields or consent forms.
4. Eligibility & Accounts
- Accounts are issued to admitted learners, approved trainers/assessors, and authorized staff/partners.
- Provide accurate information and keep your profile up to date. Do not share your password or use another person’s account.
- We may suspend or terminate access for policy violations, non‑payment, academic misconduct, or security risks.
- Enrolment into courses may require enrolment keys and/or administrative approval.
5. Learner & Staff Conduct
- Communicate respectfully in forums, chats, and messaging. Harassment, hate speech, or discrimination is prohibited.
- Do not upload or share illegal, infringing, or harmful content. Report concerns to the Platform administrator.
- Follow classroom/lab rules, assessment instructions, and safety procedures (including OSH requirements where applicable).
6. Academic Integrity & Assessment
We uphold fairness and integrity in all assessments in line with TVET assessment standards.
- Submitting work that is not your own, unauthorized collaboration, contract cheating, or using prohibited aids is misconduct.
- Platform tools (e.g., quiz integrity settings, question banks, IP/address checks, time limits) and plagiarism detection may be used.
- Assessment feedback and results are shared via the Platform and/or official channels. Formal appeals follow the procedure in Section 17.
- Practical assessments must follow competency‑based assessment (CBA) guidelines where applicable.
7. Fees, Refunds & Financial Terms
- Published fees apply to enrolment, tuition, examination, and certification. Payment instructions are provided in official notices.
- Refunds (where applicable) are processed according to Institute policy and regulatory requirements. Administrative fees and deadlines may apply.
- Non‑payment may result in suspension of access, withholding of results/certificates, or deregistration.
8. Privacy & Data Protection
We process Personal Data to deliver training, assessment, student support, quality assurance, and compliance. We comply with the Kenya Data Protection Act, 2019, its Regulations, and adopt controls aligned to ISO/IEC 27001.
Data we collect
- Identity and contact data (e.g., name, ID where required, phone, email, address).
- Academic and enrolment data (courses, grades, attendance, submissions, feedback).
- Technical data (IP address, device/browser info, access logs) for security and performance.
- Support interactions (helpdesk tickets, chat messages) and recorded consent choices.
How we use data
- Provide and improve teaching, learning, and assessment services.
- Verify identity, manage enrolments, issue certificates, and meet TVET reporting obligations.
- Maintain security (access control, auditing, incident response) and service reliability.
- Quality management (internal audits, feedback, corrective actions) under ISO 9001 principles.
Sharing & transfers
- We may share data with exam/awarding bodies, regulators (e.g., TVETA), and service providers under contracts with confidentiality and security controls.
- Cross‑border transfers (if any) follow lawful mechanisms and risk assessments.
Your rights
- Access and correction: request a copy of your data and rectify inaccuracies.
- Erasure and restriction: request deletion or restriction where legally applicable.
- Objection and withdrawal of consent: object to non‑mandatory processing or withdraw consent at any time (without affecting prior lawful processing).
- Data portability: where applicable, receive your data in a portable format.
- Complaints: you may complain to the Office of the Data Protection Commissioner (ODPC). We encourage contacting our DPO first (see Section 20).
Legal bases: contract performance, legal obligation (including TVET reporting), public interest in education, and consent (where relied upon).
Use of Google APIs (OAuth)
Where enabled, the Platform allows users to authenticate with Google and create online meetings using Google services. When a user explicitly authorises access, the Platform may access limited Google account data via Google APIs strictly for learning delivery purposes.
- Google Calendar: to create and manage Google Meet session links for scheduled classes.
- Google Meet: to facilitate live virtual training sessions.
- Google Drive: to allow access to meeting recordings where enabled by the user.
- Basic profile information: name and email address to identify the authenticated user.
Google user data is accessed only after explicit consent, used solely to provide the requested educational functionality, and is never used for advertising, profiling, or resale.
Consent, Revocation & Control
- You may revoke Google account access at any time via your Google Account security settings.
- Revocation does not affect processing that occurred before withdrawal of consent.
- Users may request deletion of Google-derived data by contacting the Institute (see Section 20).
10. Information Security (ISO/IEC 27001‑aligned)
- Access control: unique accounts, strong passwords, and least‑privilege roles in the Platform.
- Protection: regular updates, backups, encryption in transit (HTTPS), and secure hosting practices.
- Monitoring: security logging, anomaly detection, and timely patching.
- Incidents: report suspected breaches immediately to the IT Administrator; we operate an incident response procedure.
11. Acceptable Use of IT
- Do not attempt to bypass security, probe for vulnerabilities, or disrupt services.
- Use Institute resources primarily for learning/teaching. Excessive personal or commercial use is not allowed.
- Malware, pirated software, or prohibited materials are strictly forbidden.
12. Intellectual Property & Content
- Course materials are protected by copyright. Unless stated otherwise, they are for your personal learning only. Do not redistribute without permission.
- By submitting work to the Platform, you grant the Institute a non‑exclusive license to store and review it for assessment, feedback, plagiarism checking, archiving, and accreditation.
- Respect third‑party licenses (e.g., open educational resources); cite your sources.
13. Inclusion, Safeguarding & Wellbeing
- We promote an inclusive environment free from discrimination and harassment. Reasonable accommodations are available upon request.
- Safeguarding concerns must be reported to the designated officer. Content that is abusive, explicit, or unsafe will be removed and may be escalated.
- Health & Safety rules apply in all workshops and practical labs; follow trainer instructions and wear required PPE.
14. Quality Management (ISO 9001)
- We gather feedback through Platform activities (surveys, course evaluations) to drive continuous improvement.
- Nonconformities and complaints are logged, investigated, and closed with corrective actions.
- Key processes are documented; roles and responsibilities are defined for service delivery.
15. Business Continuity
- Backups and recovery procedures aim to minimise disruption of learning.
- During outages, alternative delivery (e.g., offline notes, rescheduled sessions) will be communicated through official channels.
16. Records & Retention
- Academic records, logs, and submissions are retained for periods required for academic integrity, accreditation, ODPC guidance, and TVET obligations, after which they are securely disposed.
- Users should retain copies of their submissions where appropriate.
- Illustrative periods (subject to applicable policy/law): enrolment and assessment records up to 7 years; incident/security logs 12–24 months; consent records for the duration of processing plus 2 years; finance records per tax law.
17. Complaints & Appeals (TVET)
We strive to resolve issues promptly and fairly, consistent with TVET standards for student protection and fair assessment.
- Informal resolution: Raise the issue with the trainer/assessor or course coordinator.
- Formal complaint: Submit a written complaint via the Institute’s official channel. You will receive an acknowledgement and outcome within reasonable timelines.
- Assessment appeal: For assessment decisions, submit an appeal within the specified window. Appeals are reviewed by an independent panel/second assessor.
- External escalation: Where unresolved and within mandate, you may escalate to relevant external bodies/regulators as permitted by law.
18. Third‑Party Services
The Platform may integrate third‑party plugins or services (e.g., video conferencing, plagiarism detection, analytics). Their use is subject to appropriate agreements and privacy notices. We assess third‑party risks and configure the Platform to minimise unnecessary data sharing.
Third parties act as processors or independent controllers. Where processors are used, we require confidentiality, purpose limitation, and adequate security. Cross‑border transfers use appropriate safeguards.
Google services are integrated using officially supported Google APIs and OAuth 2.0. The Institute’s use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
18A. Google API Services Disclosure
Talent Eye Training Institute’s Learning Platform uses Google API Services to enable optional features such as Google Meet scheduling and authentication.
- Data obtained from Google APIs is used exclusively to provide educational services requested by the user.
- No Google user data is sold, shared for advertising, or used beyond the stated purpose.
- Access is limited to the minimum scopes necessary for functionality.
- Data retention follows the records and retention policy outlined in Section 16.
Use of Google API Services complies with the Google API Services User Data Policy, including Limited Use requirements.
19. Changes to this Policy
We may update this Policy to reflect changes in law, standards, or our services. Changes take effect upon posting on the Platform. Where material, we will notify users via announcements or email and may require re‑consent.
Version control is maintained; archived versions are available on request.
This Site Policy also serves as the Platform’s Terms of Service for access, authentication, and use of integrated third-party services.

TVET Compliance Statement
Talent Eye Training Institute operates in alignment with applicable TVET Authority standards and guidelines, including student protection, fair assessment, assessor/Verifier qualifications, and records management requirements.
Governing Law & Jurisdiction
This Policy is governed by the laws of Kenya. Disputes shall be subject to the jurisdiction of the courts of Kenya, without prejudice to regulatory complaint mechanisms (e.g., ODPC, TVETA).
Liability & Disclaimers
- The Platform is provided with reasonable skill and care. We do not warrant uninterrupted or error‑free access; scheduled maintenance and outages may occur.
- To the maximum extent permitted by law, we are not liable for indirect or consequential loss. Nothing excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law.
- Consumer rights: This Policy does not limit rights under applicable consumer protection law.
